Legal

Terms & Conditions

These Terms govern Within7's creator messaging, inbox, profile, team, and payment services. They include important payment, safety, responsibility, and liability provisions.

1. Agreement and scope

1.1 V1 business information

This V1 is effective from the date shown above. The operator is WITHIN7 LTD, trading as Within7, a private company limited by shares registered in England and Wales with company number 17466931, incorporated on 18 September 2026.

Its registered office, and its address for correspondence, is 71–75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom.

These Terms & Conditions (the Terms) are a legal agreement between you and the operator of the Within7 service (Within7, we, us, or our). They apply when you visit Within7, register or use a creator account, join a creator's team, publish a profile, send or receive an enquiry, use an email thread, make or receive a payment, or otherwise access the websites, applications, APIs, emails, and related services we provide (together, the Service).

Where Within7 presents an acceptance control, you agree to these Terms by affirmatively checking it and completing the associated registration or transaction. Within7 records the acceptance status, document version, and time of that assent. Merely viewing a public page does not by itself prove agreement. You also acknowledge our Privacy Policy. If you affirmatively accept for a company, creator, agency, or other organisation, you confirm that you have authority to bind it. If you do not have that authority, you accept only for yourself and must not use the Service on the organisation's behalf.

Checkout disclosures, creator prices, product-specific rules, and any policies expressly linked from these Terms form part of this agreement. If a checkout disclosure conflicts with these Terms about the specific transaction, the checkout disclosure controls for that transaction. Additional written terms may apply to enterprise or other separately contracted services.

These Terms govern both Within7's relationship with every user and the additional commercial obligations a creator accepts by enabling paid enquiries. For each paid enquiry, the sender and creator also contract directly with each other for the creator's promised Qualifying Reply (the Creator Service) on the transaction terms disclosed at checkout. Within7 remains responsible for the platform services it agrees to provide, but is not the provider of the Creator Service or any later off-platform arrangement.

2. Eligibility, authority, and sanctions

You may use the Service only if you are at least 18, can enter a binding contract, and are not prohibited from using it by applicable law. The Service is not directed to children and no person under 18 may register, send an enquiry, join a team, or otherwise use it.

You must provide accurate information and must not misrepresent your age, identity, affiliation, authority, organisation, or purpose. A business sender confirms that they are authorised to act for the named business. A creator who permits a manager, assistant, agency, employee, or other collaborator to use the Service remains responsible for that person's access and conduct.

Within7 is available only where Within7 and its providers may lawfully offer it. You must not access, use, pay through, or receive funds from the Service if you are the target of applicable trade, financial, or economic sanctions; are located, organised, or ordinarily resident in a territory subject to a comprehensive embargo applicable to Within7 or its providers; or would cause Within7, a payment provider, or another user to violate sanctions, export controls, anti-money-laundering rules, or other applicable law. You must not use the Service for the benefit of a prohibited person or conceal the origin, destination, ownership, or purpose of a transaction. Within7 and its providers may screen, reject, suspend, block, report, or withhold a transaction where reasonably necessary for compliance. You remain responsible for ensuring that your use is lawful where you and the other participant are located.

Senders may pay from any country where Within7 offers checkout. A creator may enable paid enquiries and receive Creator Payouts only through a payout account opened in the creator's own name, or that of the creator's business, in a country Within7 supports for payouts (a Supported Payout Country). The Supported Payout Countries are currently the United Kingdom, the member states of the European Economic Area other than Iceland, Switzerland, the United States, and Canada, and are listed in the creator's Settings. They reflect where Within7 and its payment provider can lawfully send funds and may change; Within7 will give affected creators reasonable notice of a removal where practicable. A creator who cannot hold a payout account in a Supported Payout Country must not enable paid enquiries, and Within7 may disable paid enquiries for that creator.

3. Within7's role and the creator's independence

Within7 supplies communications, inbox, routing, profile, workflow, and payment technology. A creator chooses whether to participate, sets or approves their contact price, chooses whether and how to respond, and controls the substance of their communications. A creator may permit an authorised team member to read or reply where the Service supports it.

Creators, senders, and their representatives are independent users. They are not Within7's employees, workers, general agents, partners, representatives, franchisees, fiduciaries, or joint venturers, and they have no authority to bind Within7. A creator who enables paid enquiries acts in the course of their own business or professional activity and is the independent provider of the promised reply. Within7 facilitates the transaction and acts only as the creator's limited payment collection agent as described in section 7; that limited appointment does not make Within7 responsible for the creator's communications, advice, services, or conduct.

Except for Within7's own platform and limited payment-collection obligations under these Terms, Within7 is not a party to any later or separate introduction, pitch, offer, negotiation, engagement, sale, investment, employment, endorsement, professional relationship, or other arrangement between users, whether on or off the Service. Each user must perform their own due diligence and is solely responsible for their promises, representations, advice, services, dealings, and conduct. No profile, social connection, badge, ranking, or display is an endorsement or guarantee by Within7.

4. Accounts, teams, and verification

You must keep account, email, authentication, and recovery credentials confidential; use reasonable security; and promptly notify us of suspected unauthorised access. You are responsible for activity through your account unless caused by Within7's breach of duty. You may not sell, transfer, share, or lend an account or bypass access controls.

Creator registration may require control of a connected social account. A verified or similar badge means only that the specified account was connected through the relevant provider at the time indicated. It does not mean Within7 has verified a person's legal identity, age, credentials, background, expertise, trustworthiness, current control of every account, or compliance with these Terms.

Where a production team feature is expressly enabled, an account owner controls team access and must grant only necessary permissions, promptly revoke access that is no longer required, and ensure every team member complies with these Terms. The owner is responsible for team replies and account activity. Team members may not represent that a reply came personally from a creator if doing so would be misleading. Simulated or preview team features are not production collaboration services until expressly enabled.

5. Messages, delivery, and creator replies

Senders must verify control of the email address used for an enquiry. Within7 may route messages and replies through tagged email addresses, email providers, and the creator inbox. Delivery depends on third-party systems, spam controls, recipient settings, connectivity, and accurate addresses; delivery, receipt, reading, storage, or continued access is not guaranteed.

A creator is free to ignore, decline, accept, or answer a request unless an express transaction term says otherwise. A reply comes from the creator account; where checkout expressly discloses an enabled team feature, an attributed authorised-team reply may also count. Creators are not required to agree with a sender, accept an opportunity, continue corresponding, reach a deal, or provide any minimum length, detail, tone, originality, expertise, or result.

Within7 does not routinely pre-approve every private message. We may, however, use automated tools and human review to route communications, prevent abuse or fraud, provide support, investigate reports, enforce these Terms, and comply with law. Users should retain their own copies of important communications.

7. Creator earnings, payouts, and tax

A creator may participate as a self-employed individual, partnership, company, or other permitted entity, but by enabling paid enquiries the creator confirms that they do so in the course of their independent business or professional activity. The creator is the seller and provider of the Creator Service and is responsible for accurately identifying themselves and any applicable trader or business status.

For each paid enquiry, the creator appoints Within7 as their limited agent solely to facilitate, collect, reconcile, refund, and remit that transaction's payment through Within7's payment provider. A captured payment to Within7 or its payment provider on the creator's behalf satisfies the sender's payment obligation for that transaction, subject to any refund, reversal, or chargeback. This limited appointment does not authorise Within7 to make promises for the creator or control the creator's reply or conduct. Stripe processes sender payments and connected-account payouts under its own terms. By enabling paid enquiries the creator also agrees to Stripe's Connected Account Agreement and other applicable Stripe terms, which Stripe presents when the creator sets up payouts, and understands that Stripe may refuse, restrict, or close a connected account. Within7 is not a bank, deposit-taker, escrow service, or trustee, and no creator may describe it that way.

Gross Receipts are the total amount captured from the sender for a paid enquiry, including any optional added amount but excluding any VAT, GST, sales, or similar tax that Within7 is required to charge, collect, or account for on the transaction. The percentage applied to Gross Receipts (the Creator Rate) and Within7's corresponding platform fee will be conspicuously displayed to the creator before the creator enables paid enquiries and must be affirmatively accepted. At launch the Creator Rate is 70% of Gross Receipts and Within7's platform fee is the remaining 30%. The Creator Payout is the Creator Rate applied to Gross Receipts, rounded down to the nearest minor currency unit, subject to permitted adjustments; Within7 retains the balance as its platform fee. Within7 bears the payment-processing and foreign-exchange costs attributable to the transaction, and those costs do not reduce the Creator Payout. Taxes, refunds, reversals, chargebacks, dispute fees, and other amounts that these Terms or applicable law place on the creator may be deducted or recovered separately. The dashboard or checkout may show estimates of amounts and timing; provider records determine the amounts actually captured, refunded and paid out. Within7 may change the Creator Rate or platform fee only prospectively after reasonable notice and any further affirmative acceptance required by law; a change will not alter a transaction already submitted.

Within7's payment account settles in pounds sterling (GBP). Where Gross Receipts are captured in another currency, the payment provider converts them to GBP when the payment is captured, at the provider's exchange rate at that time. For such a transaction the Creator Payout is the Creator Rate applied to that converted amount, before any fee is deducted (the Settled Gross Receipts), rounded down to the nearest penny. Within7 bears the provider's conversion and processing fees, which do not reduce the Creator Payout. Once a payment is captured, the creator's Payments page shows the Creator Payout in GBP alongside the amount in the transaction currency.

The Creator Payout becomes eligible for payout only after capture and remains subject to refunds, reversals, chargebacks, fraud review, provider restrictions, reserves, and any displayed payout threshold. Within7 pays a creator's balance once it reaches the payout threshold shown in the creator's Settings and Payments pages; a smaller balance is paid once its earliest amount has been payable for 30 days. After Within7 sends an amount to the creator's payment account, the timing of payment to the creator's bank is controlled by Stripe and that bank. Within7 sends Creator Payouts in GBP. If the creator's payout account holds a different currency, the payment provider converts the amount on arrival at its exchange rate at that time. Within7 bears any conversion or cross-border fee the provider charges Within7 for sending a payout; the creator bears exchange-rate movements after capture and any charge made by the creator's own bank, and Within7 does not guarantee the amount received in any currency other than GBP. The creator authorises Within7 to refund a sender where section 6 permits or law requires it and to deduct the creator's corresponding share and associated costs from amounts due, a reserve, or future payouts. If those amounts are insufficient, the creator must repay the shortfall on request. Within7 may withhold or recover funds only on a reasonable contractual, provider, risk, or legal ground, for a proportionate period, with periodic review and notice and an appeal route where legally and safely possible. The payment provider conducts its own identity and business checks and controls connected-account eligibility, bank-account requirements, and onward payout timing. Within7 remains responsible for its own onboarding, tax and platform-reporting, disclosure, and other duties that apply directly to Within7.

The creator chooses the country of their payout account when setting up payouts, from the Supported Payout Countries. The payment provider fixes that country once the account is created, and it determines the account's currency and the information the provider requires. In some countries, including the United States and Canada, the provider requires the account to hold a card-payments capability even though Within7 never takes payments through it; the creator authorises Within7 to give the provider a business category, a statement name, and the creator's public Within7 profile address for that purpose. A creator who moves, or whose payout account is in the wrong country, must contact Within7. Changing country may require closing the payout account and opening a new one, subject to the provider's rules and to any balance being settled first.

If a creator has not completed payout setup, or their payout account is closed or restricted, Within7 continues to record the Creator Payouts owed to them, will remind them how to receive them, and will pay, return, or otherwise deal with any amount that remains unclaimed only as applicable law permits.

Creators must provide accurate identity, business, trader, ownership, payout, tax-residence, and tax-registration information; complete all provider verification; keep the information current; issue or permit Within7 to issue required transaction records on their behalf; and maintain records required by law. Creators are responsible for income, profits, sales, VAT/GST, employment, and other taxes arising from their activity or Creator Payout, except to the extent Within7 is legally required to calculate, collect, withhold, report, or remit an amount. Within7 may request supporting documents and provide information about creators and transactions to payment providers, tax authorities, or other competent authorities where reasonably necessary or legally required.

Within7 may be a reporting platform operator under the UK Platform Operators (Due Diligence and Reporting Requirements) Regulations 2023 and comparable rules in other countries, including those implementing the OECD Model Rules for Reporting by Platform Operators, such as the European Union's DAC7 rules. Where they apply, Within7 must collect and verify information about creators, including name, address, date of birth, tax identification number, country of residence, payout account details, and the amounts paid and fees retained in each quarter, and report it to HM Revenue & Customs or another competent tax authority, which may share it with the tax authority of the creator's country of residence. Within7 will give creators the information reported about them. If a creator does not provide required information after reminders, Within7 may suspend paid enquiries or withhold Creator Payouts to the extent those rules permit or require. Where law or the payment provider requires a tax form, such as a United States Form W-9 or W-8, or requires an amount to be withheld, Within7 or the provider may collect the form and withhold that amount.

Each creator is responsible for any VAT, GST, or similar tax due on the Creator Service they supply, except where tax law treats Within7 as the supplier, deemed supplier, or collector of tax for a transaction; in that case Within7 accounts for that tax, and it is excluded from Gross Receipts.

The creator authorises Within7 to display or provide the creator's legal or business identity, contact details, trader status, and transaction records to senders where required by law. The creator is responsible for consumer, invoicing, licensing, and other legal obligations arising from the Creator Service, except for obligations that apply directly to Within7 and cannot lawfully be transferred.

8. Acceptable use and prohibited conduct

You must not use, request, encourage, or facilitate the Service to:

  • create, send, solicit, store, link to, or distribute illegal, harmful, sexually explicit, pornographic, nude, lewd, fetish, exploitative, violent, hateful, threatening, harassing, defamatory, deceptive, or privacy-invasive material;
  • groom, sexually solicit, exploit, endanger, traffic, blackmail, or sextort any person, or create or share intimate imagery without free, informed, and lawful consent;
  • stalk, bully, doxx, intimidate, discriminate, impersonate, defraud, misrepresent affiliation, manipulate media deceptively, or invade another person's privacy or confidentiality;
  • promote or transact in unlawful goods, controlled substances, weapons, trafficking, criminal services, or regulated activity for which you lack required authority or licences;
  • infringe intellectual property, publicity, data protection, consumer, contractual, or other rights, or disclose another person's personal, confidential, or sensitive information without lawful authority;
  • send spam or unlawful marketing, scrape or harvest data, buy or sell access, evade blocks, create deceptive accounts, manipulate prices or payments, or divert a transaction to evade Within7 fees;
  • upload malware, phishing material, credentials, payment-card data, or code intended to damage, surveil, disrupt, reverse engineer, overload, or gain unauthorised access to the Service or another system;
  • use automated access except through an interface Within7 authorises, or interfere with rate limits, security, moderation, reporting, or payment controls; or
  • provide medical, legal, financial, investment, safeguarding, or other regulated advice unless properly qualified and legally authorised, or present an informal creator message as professional advice.

Creators may use sender data only to review and respond to the relevant enquiry, manage the resulting relationship, comply with law, and for any other purpose for which they have a separate valid legal basis and have given required notice. They must not sell, scrape, enrich, publish, or use sender details for unrelated marketing merely because Within7 made the enquiry available.

To the extent a creator or their organisation determines its own purposes and means for using sender information, it acts independently from Within7 and is responsible for its own privacy notices, lawful basis, security, retention, rights handling, and other data-protection duties. Nothing in this allocation removes Within7's responsibility for Within7's own processing.

9. Child safety and sexual-content prohibition

Never create, solicit, possess, transmit, threaten to transmit, or link to child sexual abuse material; the sexualisation, grooming, solicitation, trafficking, or exploitation of a child; or any real, altered, animated, or generated depiction that is unlawful or appears to involve a child. Never ask a child to move a conversation elsewhere, conceal contact, meet, share intimate material, or provide money or personal information.

If a creator or sender knows or suspects that another participant is under 18, they must stop communicating through Within7, must not send or solicit sexual or otherwise age-inappropriate content, and should block and report the account. Users may not rely on a profile, email, statement, payment card, or appearance as proof of age.

Within7 may immediately restrict accounts and transactions, preserve evidence, remove or disable access, and notify affected services. Where the law requires Within7 to report or preserve information about suspected child sexual exploitation or abuse, Within7 will do so through the reporting route that applies to it, and it may make a further voluntary report to a competent authority where the law permits it. Do not download, copy, forward, or redistribute suspected child sexual abuse material in order to report it; report the location and available non-content details instead. Call local emergency services where anyone faces immediate danger.

10. Your content and licences

User Content includes profile text, social information, messages, replies, saved replies, files, comments, reports, feedback, and other material a user submits, connects, or makes available. You retain ownership of your User Content and remain solely responsible for it. You confirm that you have all rights, permissions, notices, and lawful bases needed for Within7 and other intended recipients to process it as described here and in the Privacy Policy.

You grant Within7 a non-exclusive, worldwide, royalty-free licence to host, cache, reproduce, format, transmit, display, route, deliver, scan, moderate, investigate, preserve, back up, and otherwise use User Content only as reasonably necessary to provide, secure, troubleshoot, support, and enforce the Service; comply with your settings and instructions; and meet legal obligations. This licence does not permit private-message content to be used for general-purpose model training, targeted advertising, or unrelated analytics. It ends when the relevant content is deleted from active systems, except for lawful retention, evidence, backups, and content separately received or retained by another user.

Feedback about Within7 may be used without restriction or payment, but we will not identify you publicly as its source without permission. We do not claim ownership of a creator's name, likeness, brand, or social content merely because it is connected to Within7.

11. Privacy, confidentiality, and sensitive information

Our Privacy Policy explains Within7's use of personal information. A message will be disclosed to the selected creator and, only where a production team feature is expressly enabled, may be accessible to authorised workspace members. Within7 personnel and providers may access messages where necessary for delivery, support, safety, payments, security, or law. Messages are not end-to-end encrypted. Within7 does not create a professional duty of confidentiality or legal privilege, and using an ordinary messaging service may compromise confidentiality; whether privilege exists is fact-specific.

Do not send passwords, authentication codes, full payment-card numbers, bank credentials, government identifiers, medical records, highly sensitive personal data, trade secrets, legally privileged material, or information you are not authorised to disclose. Although users must respect privacy and confidentiality, Within7 cannot guarantee that a recipient will keep a message confidential or refrain from taking a screenshot, forwarding, exporting, or using it off-platform.

12. Within7 intellectual property

Within7 and its licensors own the Service, software, design, databases, branding, and related intellectual-property rights, excluding User Content. Subject to these Terms, Within7 grants you a limited, non-exclusive, non-transferable, revocable right to use the Service for its intended purpose. No rights are granted by implication.

You may not copy, resell, sublicense, frame, mirror, extract, reverse engineer, or create derivative services from Within7 except to the extent the restriction is prohibited by law or Within7 gives written permission. If you believe content infringes your rights, send a sufficiently detailed notice to the contact in section 23. Within7 may request identity, ownership, location, good-faith, and accuracy declarations and may process counter-notices where applicable.

13. Moderation, reporting, and investigations

Within7 does not undertake to monitor or pre-screen every message and does not guarantee that it will detect every breach. This does not limit any legal duty to act. We may use automated signals and human review and may access, restrict, remove, or preserve content and account data where reasonably necessary and legally permitted to operate the Service, investigate a report, protect people or systems, enforce these Terms, prevent fraud, or resolve a dispute. Within7 discloses private message content outside its intended delivery and service-provider chain only where required by law or valid legal process, for a mandatory safety report, or on a documented emergency basis recognised by applicable law.

Reports should identify the relevant profile, conversation or content, explain the concern, and include safe supporting information. We may acknowledge and assess reports, request further information, notify an affected user where appropriate, restrict features or payouts, and provide a route to challenge an enforcement decision. We may withhold details where disclosure could prejudice safety, an investigation, another person's rights, or legal obligations. Knowingly false or abusive reporting is prohibited.

14. Third-party services and links

The Service relies on providers for authentication, social connections, email, hosting, storage, databases, payment processing, identity checks, and payouts. Their separate terms and privacy practices may apply. Within7 does not control an external site, social network, card issuer, payment provider, or off-platform communication and is not responsible for it, except to the extent liability arises from Within7's own breach of law or duty and cannot be excluded.

Connected social information may become stale, incomplete, or unavailable. Disconnecting a provider may disable related features but does not necessarily delete transaction, safety, or other records Within7 must retain. You must comply with the applicable provider's terms and must not use Within7 to circumvent its controls.

If you connect a YouTube channel, Within7 uses YouTube API Services and, by connecting, you agree to be bound by the YouTube Terms of Service. Google's handling of your information is described in the Google Privacy Policy, and you can revoke Within7's access at any time in your Google security settings.

15. Availability, previews, and changes

We may maintain, change, discontinue, or introduce features and limits, including beta or preview features. Preview features may be incomplete, simulated, or changed without notice and must not be relied on for production, safety-critical, or regulated purposes. We do not promise uninterrupted, error-free, secure, or permanent availability, but this does not reduce any service standard required by mandatory law.

We may update these Terms for legal, safety, security, product, provider, or commercial reasons. We will post the new version and date and give reasonable advance notice of material changes where required. Changes apply prospectively. If consent is legally required, we will request it. Continued use after an effective date constitutes acceptance only where lawful.

16. Suspension, termination, and account closure

You may stop using Within7 at any time and may request account closure. We may warn, restrict, suspend, or terminate access; remove content; cancel transactions; hold payouts; or block communications where reasonably necessary for security, safety, fraud prevention, provider requirements, legal compliance, non-payment, material or repeated breach, or risk to Within7 or others. Urgent action may occur without prior notice. Otherwise, Within7 will give notice and reasons, an opportunity to cure where appropriate, and a contact-based appeal where legally and safely possible. A restriction or payout hold must be proportionate, tied to an identified ground, and reviewed periodically rather than left open-ended.

On termination, your licence to use the Service ends. Accrued payment obligations, lawful deductions, disputes, and provisions intended by their nature to survive—including content responsibility, intellectual property, confidentiality, indemnity, disclaimers, liability, and dispute terms—continue. Account closure does not require deletion of data that must or may lawfully be retained, as explained in the Privacy Policy. Pending sender authorisations must be captured or released under the transaction rules, and undisputed creator earnings remain payable subject to permitted deductions and provider requirements.

17. Indemnity for creators and business users

This section applies only to creators and users acting wholly or mainly for business, trade, craft, or professional purposes. To the extent permitted by law, you will defend, indemnify, and hold harmless Within7 and its personnel from third-party claims and the directly resulting losses, damages, and reasonable professional costs, to the extent caused by your User Content, conduct, team members, Creator Service or later dealings, unlawful marketing, infringement, privacy breach, tax obligations, misrepresentation, sanctions violation, payment dispute or chargeback caused by your breach, or violation of these Terms or law.

Within7 will give reasonable notice, allow you to participate in the defence, and not settle a claim in a way that admits your wrongdoing or creates a non-monetary obligation for you without consent, not to be unreasonably withheld. This indemnity does not cover loss caused by Within7's own negligence, wilful misconduct, or breach of law, and does not apply to consumers acting outside a business.

18. Disclaimers

To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis, and Within7 disclaims implied warranties and conditions to the extent they may lawfully be disclaimed. Within7 does not warrant or guarantee any creator, sender, or team member; any reply, profile, claim, recommendation, credential, identity, age, availability, legality, tone, accuracy, originality, completeness, usefulness, professionalism, or outcome; any introduction or later transaction; uninterrupted, secure, or error-free delivery or storage; or any third-party service.

Creator messages are the creator's or authorised team member's own content and are not Within7 statements or advice. Within7 does not select the message's subject, direct how a creator responds, or assume a duty to supervise a user's conduct merely by providing the Service. Within7 does not adopt or endorse User Content by transmitting, displaying, reviewing, restricting, or failing to detect it. Each user decides whether to rely on another user and bears the risk of any independent interaction or arrangement with them. Nothing in these Terms disclaims a responsibility Within7 has expressly accepted or a duty that applicable law does not allow Within7 to exclude.

19. Limits on liability

19.1 Liabilities never excluded

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence; fraud or fraudulent misrepresentation; deliberate misconduct; breach of a duty that cannot lawfully be limited; or any other liability, remedy, or statutory right that applicable law does not permit us to exclude or limit.

19.2 User content and independent conduct

Subject to section 19.1 and to the maximum extent permitted by law, Within7 is not liable for a user's content, statements, omissions, identity, age, qualifications, conduct, breach, or off-platform acts; a recipient's copying, forwarding, disclosure, or misuse of a message; the quality or substance of a Qualifying Reply; reliance on another user; or any introduction, negotiation, agreement, service, opportunity, or relationship between users. This allocation does not exclude loss caused by Within7's own breach of these Terms, negligence, or mandatory legal duty.

19.3 Consumers

If you are a consumer, Within7 is responsible for foreseeable loss or damage caused by our breach of these Terms or failure to meet an applicable mandatory service standard. We are not responsible for loss that was not reasonably foreseeable when the agreement was formed, was caused by your breach or failure to take reasonable steps, or relates to business use. A creator remains responsible for their independent content and conduct, but this does not exclude Within7's responsibility for its own acts, omissions, negligence, or statutory duties.

19.4 Creators and business users

If you use Within7 for business purposes, to the maximum extent permitted by law and subject to applicable fairness and reasonableness requirements, Within7 will not be liable for indirect or consequential loss, or for loss of profits, revenue, business, contracts, opportunities, anticipated savings, goodwill, reputation, business data, or business continuity. Within7's aggregate liability arising from or relating to the Service during any rolling 12-month period will not exceed the greater of the platform fees Within7 actually retained from transactions involving you during that period and the total value of the transaction giving rise to the claim.

The cap does not apply to the liabilities listed in section 19.1 or to any liability that applicable law requires to remain uncapped. Each party must take reasonable steps to mitigate loss.

20. Mandatory rights

Nothing in these Terms affects rights and remedies that cannot be waived, including applicable rights concerning fair terms, digital services, payment services, data protection, cancellation, refunds, and applicable service-quality standards. If a provision is inconsistent with a mandatory right in your country, that right prevails and the provision applies only to the maximum lawful extent.

Before a consumer pays for an enquiry, Within7 asks the sender to confirm that they want the reply service to start immediately and to acknowledge that they lose any statutory right to cancel once a Qualifying Reply has been accepted for sending. Until a Qualifying Reply has been accepted for sending, a consumer may withdraw an enquiry by contacting Within7, and Within7 will ask the payment provider to release the authorisation; withdrawing cannot recall a message that has already been delivered. After a Qualifying Reply the service has been fully performed and the right to cancel ends, but nothing here limits a refund or remedy that the law requires.

21. Governing law and disputes

Please contact Within7 first so we can try to resolve a concern. These Terms and any non-contractual disputes arising from them are governed by the laws of England and Wales. The courts of England and Wales have non-exclusive jurisdiction.

If you are a consumer, this choice does not deprive you of mandatory protections of the country where you habitually live. If you live in Scotland or Northern Ireland you may also bring proceedings in the courts of that part of the United Kingdom, and you may bring proceedings in any court available to you under applicable consumer law. Nothing requires private arbitration or waives participation in a collective remedy where such a restriction would be unlawful or unfair.

If you are a business user, including a creator who enables paid enquiries from outside the United Kingdom, this choice of law and courts does not remove any protection that mandatory law where you are established gives business users of online platforms or intermediation services, and you may use any complaint-handling, mediation, or court route that such law makes available to you.

22. General terms

These Terms and incorporated transaction disclosures are the entire agreement about the Service, except a separately signed agreement. A delay in enforcing a right is not a waiver. If a provision is invalid or unenforceable, it will be limited to the minimum extent necessary and the remainder will continue. Headings are for convenience only; words such as “including” do not limit what follows.

You may not assign these Terms without Within7's written consent. Within7 may assign them as part of a merger, reorganisation, financing, sale of business or assets, or transfer to an affiliate, provided consumer rights are not reduced. Neither party is liable for delay caused by events beyond reasonable control, except that this does not excuse payment obligations already due or duties that law does not permit to be excluded.

Notices may be delivered to the email associated with an account, in the Service, or on this page. You must keep contact details current. Electronic records and acceptance may be used to evidence the agreement. No person other than a party has a right to enforce these Terms, except that an indemnified person may enforce section 17 where applicable law permits.

23. Contact

Questions, complaints, safety reports, payment concerns, and legal notices may be sent through the Contact page or by email to [email protected]. Include enough information for us to identify the relevant account, message, transaction, or right without sending prohibited material.
